§1 General provisions
- The online store available at sklep.modesta.pl is operated by: MODESTA Sp. z o.o. S.K.A. with its registered office in Lublin (20-712), ul. Parysa 70, registered in the National Court Register by the District Court Lublin-East in Lublin with its seat in Swidnik, 6th Commercial Division, KRS: 0000447645, NIP: 7123099689, REGON: 060316140.
- These Terms & Conditions define the rules of using the Store, placing orders, and the rules for concluding sales contracts.
- All product information published on the Store website, in particular descriptions, technical parameters and prices, do not constitute an offer within the meaning of Art. 66 of the Polish Civil Code, but are an invitation to conclude a contract within the meaning of Art. 71 of the Polish Civil Code.
§2 Placing orders and concluding the contract
- The Customer places an order through the Store interface (adding a product to the cart and confirming with the "Order with obligation to pay" button or equivalent).
- Placing an order by the Customer constitutes an offer to purchase the product made to the Seller.
- After receiving the order, the Seller sends an automatic confirmation of its receipt to the Customer's e-mail address. This confirmation is informational and does not constitute acceptance of the offer.
- The sales contract is concluded only when the Seller expressly confirms acceptance of the order for fulfillment, which takes place in a separate e-mail sent to the Customer after verification of availability and feasibility of the product.
- The Seller reserves the right to refuse to accept an order in justified cases (e.g. lack of raw materials for production of a specific order).
§3 Order fulfillment and custom products
- Due to the specificity of the offered products, many of them are manufactured to the individual order of the Customer.
- The order fulfillment time is confirmed by the Seller on a case-by-case basis. For personalized products, this time may be extended, of which the Customer will be informed.
- Prices listed in the Store are gross prices (including VAT).
§4 Right of withdrawal
- The Consumer has the right to withdraw from the contract within 14 days without giving a reason, subject to paragraph 2.
- The right of withdrawal does not apply to contracts where the subject is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy their individualized needs (pursuant to Art. 38(3) of the Consumer Rights Act).
§5 Complaints
- The Seller is obliged to deliver a product free from defects.
- Complaints should be submitted electronically to: info@modesta.pl or by mail to the registered office address.
- The Seller will respond to the complaint within 14 days.
§6 Final provisions
- In matters not regulated herein, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
- The Seller reserves the right to amend the Terms & Conditions for important technical or legal reasons.
